Membership Agreement

This agreement is between you (the member) and Evolution Fitness Leicester Ltd (“we”, “us”, “the Club”).
This agreement begins once you have confirmed acceptance during the in-club or online sign-up process.
- If you did not sign up on club premises, you have 14 full days from the date of sign-up to cancel this agreement for any reason.
- To exercise this right, you must notify us by post, email, telephone, or other stated contact methods.
- If you cancel within this period, we will refund all joining and membership fees paid, using the same payment method. Where the facilities have been used, the refund will be reduced on a pro-rata basis.
Your membership begins immediately unless a future start date is selected at sign-up.
You are entitled to all rights and privileges associated with your chosen membership type, subject to full and timely payment.
Club Right Ltd administers Direct Debit payments relating to your membership on our behalf.

The joining fee or initial payment is payable immediately and is non-refundable, except where statutory rights apply.
You agree to pay all monthly Direct Debit fees for the full minimum term of your membership contract.
If a Direct Debit payment is unpaid, we may use any alternative payment method authorised by you at sign-up to recover the outstanding amount.
You must inform us promptly of any changes to your personal or payment details.
Any outstanding balance overdue by more than 30 days may be referred to a third-party debt recovery agency. You will be liable for any reasonable costs incurred in recovering the debt.

Once the minimum membership term has ended, your membership will automatically continue on a rolling monthly basis unless cancelled with at least 30 days’ notice.
Cancellation requests may be submitted by email, app, in person, in writing, telephone, or SMS.
Where less than 30 days’ notice is provided, one further payment may be taken.

Early cancellation may be permitted if you permanently relocate more than 15 miles from the Club, subject to acceptable proof.
Early cancellation may be permitted in cases of long-term illness or injury lasting three months or more, subject to medical evidence.
Early cancellation may be permitted in cases of redundancy, subject to employer documentation.
Early cancellation may be permitted in the event of pregnancy, subject to written confirmation.
Early cancellation may be permitted where we are found to be in material breach of this agreement.

Memberships may be frozen for medical reasons only, subject to appropriate evidence.

Approved freeze periods suspend access to the facilities only.
Freeze periods do not pause, reduce, or remove Direct Debit payments, nor do they shorten the remaining contractual term, unless otherwise agreed in writing.

Membership fees are non-refundable, except where cancellation or freezing has been approved in accordance with this agreement or where statutory rights apply.
No refunds will be issued where a member fails to provide valid cancellation or freezing grounds as defined in clauses 14–19.
Failure to attend or use the Club facilities for any period of time does not constitute grounds for a refund, freeze, or cancellation.
It is the member’s responsibility to manage their membership, including attendance, submitting cancellation requests, and applying for freezes. The Club accepts no responsibility for non-usage by the member.

All members must comply with the Club Rules displayed in the facility and communicated by staff.
Failure by us to enforce any term at any time does not waive our right to enforce it later.
If any term of this agreement is deemed invalid or unenforceable, the remaining terms shall remain in full force and effect.
This agreement is governed by the laws of England and Wales, and any disputes shall be subject to UK jurisdiction.

We may amend membership prices from time to time. Members will receive at least 30 days’ written notice prior to any price increase.
Continued use of the membership after the effective date of the price change constitutes acceptance of the new price.
Members may cancel their membership in accordance with clause 11 before the price increase takes effect.

We reserve the right to terminate a membership immediately and without refund for serious breaches of Club Rules, including but not limited to theft, violence, abuse, threatening behaviour, or other criminal conduct.
